Promotion
- CoinSpot is celebrating reaching 3 million users by giving you the chance to win a share in a Prize Pool valued at AUD $1,107,129.64 in Mission 3M (‘the Promotion’).

Terms and Conditions
- The Promotion is governed by the terms and conditions as displayed on CoinSpot’s websites and Platform.
- Any information on the Platform relating to this Promotion, including, but not limited to, the:
- eligibility requirements of the Promotion;
- method by which an entry in the Promotion is to be made; and/or
- prize.
- form part of the Terms and Conditions of the Promotion.
- You acknowledge that by participating in the Promotion you are providing your irrevocable agreement to be bound by the Terms and Conditions.

Promotional Period
- The Promotion will commence and terminate on the dates and times specified below (‘the Promotional Period’):
- Start Date: 10:00 am AEST on 13 May 2025
- End Date: 17:00 pm AEST on 27 May 2025
- A day, for the purposes of the Promotional Period, will commence at 12:00am AEST and end at 11:59pm AEST of the same day.
- Subject to relevant regulatory approval, CoinSpot reserves the right to amend the end date of the Promotional Period at its absolute discretion and any decision exercised under this clause is not subject to review.

Eligibility
- Entry to the Promotion is open to all individuals who, at the time of entry, meet the following criteria:
- You are an Australian resident;
- You are over eighteen (18) years of age; and
- You are a natural person (not a corporate or government entity).
- Employees, immediate family members, retailers, suppliers, associated companies and agencies related to CoinSpot are not eligible to enter into the Promotion.
- All entries made by individuals who are not eligible will be automatically deemed invalid, without exception.
- CoinSpot reserves the right to, at any time, verify the validity of any entry into the Promotion and the eligibility of a Participant (including but not limited to the Participant’s identity, age and place of residence) and to disqualify any Participant that does not meet the eligibility requirements outlined in Clause 4. Failure by CoinSpot to enforce any of its rights at any stage does not constitute a waiver of those rights.

How to Enter
- To enter the Promotion, an eligible person must:
- Have an existing CoinSpot account or have created a new CoinSpot account in their own name prior to the end of the Promotional Period;
- Have completed the identity verification processes required by CoinSpot; and
- ‘Tap to Fuel Up’ and receive fuel tickets or an instant win prize via the official CoinSpot promo page
- Any eligible person who complies with Clause 5.1 (‘a Participant’) will have successfully participated in the Promotion, and receive one of the prizes listed in Clause 6.3.
- A Participant can only enter the Promotion once per day throughout the Promotional Period.
- A Participant with multiple CoinSpot accounts registered to their name or to entities that they are associated with, is only permitted to enter the Promotion once per day in the Promotional Period. The Participant must use their individual CoinSpot account to enter the Promotion.
- All entries will be deemed accepted at the time of receipt by CoinSpot.
- All entries made in the Promotion are final.

Prize
- There will be multiple winning Participants of the Promotion. The number of winning Participants will be determined by the number of Participants who successfully claim a Prize when taking part in the Promotion.
- A participant who has complied with Clause 5.1, will become a winning participant via an automated, randomisation process. The system randomly assigns one prize from the total Prize Pool without human intervention, ensuring all participants have an equal chance.
- The Prize Pool contains the following Prizes:

- Each winning Participant will receive one (1) Prize from the Prize Pool each day throughout the Promotional Period.
- All Prizes will be awarded in the name of the particular winning Participant.
- Each winning Participant will be notified of the Prize won immediately after participating in the Promotion. The Prize awarded to the winning Participant will be displayed when the Participant selects the applicable button on the CoinSpot website or in the CoinSpot App.
- One Fuel Ticket is one entry into the Major Prize Draw, Fuel tickets have no AUD value.
- All BTC, ETH, XRP, SOL and DOGE Prizes listed on 6.3.12 - 6.3.16 will be purchased using CoinSpot’s instant buy function and will be calculated with the conversion rate set at the exact time the BTC, ETH, XRP, SOL or DOGE is credited to the winning Participant’s CoinSpot account.
- A winning participant of prize 6.3.12 - 6.3.16 who is a resident of Australian Capital Territory (ACT), will receive the equivalent dollar value in AUD
- Winning Participants who receive any of the Prizes at Clauses 6.3.1 to 6.3.11 will be automatically entered into the Major Prize Draw at the time they claim their Prize.

The Draw & The Major Prize Draw
- The Major prizes are;

- Major prizes will be awarded to nine winning participants. The price of ETH will be calculated as per the Buy Price on the Platform, at the time of credit.
- The draw to determine the winning Participants of the Major Prizes (‘the Major Prize Draw’) will take place on 28 May 2025 12:00 PM AEST Suite 4, 5/40 Green Street, Windsor 3181 after the conclusion of the Promotion.
- The winning Participants of the Major Prizes will be determined by a computerised random draw.
- The major prize draw will be conducted in descending order by prize value.
- A winning participant of Major Prize 7.1.1 - 7.1.3, has the option to receive a fixed cash prize instead of AUD $100,000. This amount has been set prior to the competition launch and remains fixed, regardless of BTC’s value at the time of the draw.
- A winning participant of prize 7.1.4 - 7.1.6 who is a resident of Australian Capital Territory (ACT), will receive AUD $10,000
- The first initial, last name and postcode of the winning Participants of the Major Prize Draw will be communicated to all CoinSpot users subscribed to CoinSpot’s marketing emails and published within 48 hours on CoinSpot’s verified social media channels for a period of no less than twenty-eight (28) days. By entering the Promotion, each winning Participant consents to the publication of this information.
- Winners of the major prize draw will be notified in writing within 48 hours of the draw.
- In the event that any winning Participant’s entry is deemed or found to be invalid, CoinSpot is not obligated to provide the applicable Prize.
- Redraw/Unclaimed Prizes - In the event of an entry being deemed invalid, or a winner not claiming their prize within 21 days, a redraw will occur on the 25th of June, 2025 at 12:00pm AEST at Suite 4, 5/40 Green Street, Windsor 3181.

Redemption and Delivery of Prizes
- The redemption period commences on the date of the Draw and ends three (3) months from the date thereof.
- Each winning Participant is required to redeem their Prize within the redemption period. If a winning Participant does not redeem their Prize within the redemption period, the Prize will be deemed to be forfeited by the winning Participant.
- A winning Participant will be taken to have redeemed their Prize upon selecting the applicable button in the Promotion via the CoinSpot App or on the CoinSpot website.
- The winning Participants of the Major Prize Draw will be taken to have redeemed their Prize upon confirming verbally or in writing that they accept the Major Prize when notified by CoinSpot that they have won.
- Prizes will be provided to winning Participants within forty-five (45) days of the end of the redemption period.
- Prizes will be taken to have been provided to winning Participants once the Prize has been either:
- For Prizes as described at Clauses 6.3.12 to 6.3.16 & 7.1.1 to 7.1.6, transferred into the winning Participant’s CoinSpot account; or
- For Prizes as described at Clauses 7.1.7 to 7.1.9, delivered to the winning Participant’s Australian address.
- If any Prize is unavailable and CoinSpot has used all reasonable efforts to arrange the Prize, CoinSpot may, in its absolute discretion, reserve the right to substitute the Prize with a Prize of equal value and/or specification, subject to any written directions from a regulatory authority.

General
- Any decision made by CoinSpot in relation to the conduct of the Promotion or the determination of the winning Participant of the Prize is final and cannot be contested, disputed or challenged in any way.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (‘Non-Excludable Guarantees’).

Loss and Liability
- Despite anything to the contrary, to the maximum extent permitted by law, CoinSpot will not be liable under these Terms and Conditions for any consequential loss including but not limited to any special, indirect or consequential loss, loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use (including both real and anticipatory) and/ or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.
- Except for any liability that cannot by law be excluded by law (including the Non-Excludable Guarantees), CoinSpot (including its respective officers, employees and agents) will not be liable to a Participant for, and the Participant indemnifies, waives and releases CoinSpot in respect of all liability (including but not limited to all expenses, costs, damages, claims, losses) arising in any way out of or in connection with:
- any act or omission of the Participant;
- any breach of these Terms and Conditions by the Participant;
- any Force Majeure;
- a matter arising out of Clause 12 of these Terms and Conditions;
- any personal injury or loss;
- claiming any Prize;
- use of any Prize in any way;
- any theft of any Prize or unauthorised access or third party interference in the Promotion;
- any entry or Prize claim that is late, lost, altered, damaged, delayed or misdirected (whether or not after their receipt by CoinSpot) due to any reason beyond the reasonable control of CoinSpot; or
- any tax liability incurred by a winning Participant.

Force Majeure
- If performance of the Promotion, provision or use of the Prize (or any part of it), or any obligation under these Terms and Conditions is prevented, restricted, or interfered with by a Force Majeure, and if as a result CoinSpot is unable to carry out its obligations or to provide the Participant with the Prize (or any part of it), CoinSpot may in its absolute discretion, subject to any written directions made under any applicable legislation, cancel, terminate, modify or suspend the Promotion and/or, if necessary, provide an alternative Prize or Prizes to the same value as the original Prize.
- CoinSpot will give public notice, by way of publication on our verified social media channels, of such an event and that the Promotion has been cancelled, terminated, modified or suspended.
- Force Majeure means any event or circumstance beyond CoinSpot’s reasonable control includes, without limitation, epidemic, pandemic (including COVID-19, and any mutations or variations to this disease or illness), acts of God, fire, explosion, vandalism, storm or other similar occurrence, orders of acts of military or civil authority, or by national emergencies, insurrections, riots, or wars, strikes, lock-outs and work stoppages, terrorism, infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion.
- CoinSpot will use reasonable efforts under the circumstances to avoid or minimise any Force Majeure.
- An act or omission will be deemed within the reasonable control of a party if committed, omitted, or caused by such party, or its employees, officers, agents, or affiliates.

Personal information
- CoinSpot collects personal information in order to conduct the Promotion and for other purposes as set out in the entry form or page for the Promotion and may, for this purpose, collect, use and disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and as required, to regulatory authorities.
- Entry is conditional on providing this information.
- Participants should direct any request to opt out, access, update or correct information to CoinSpot.
- All entries, including the personal information contained in them, become the property of CoinSpot. View CoinSpot’s Privacy Policy here.

Disputes
- In the event that a dispute arises as to the identity of a Participant , the entry will be deemed to have been submitted by the authorised account holder of the email address.
- The authorised account holder means the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organisation that is responsible for assigning email addresses for the domain associated with the email.
- CoinSpot may ask any Participant to provide CoinSpot with proof that such party is the authorised account holder of the email address associated with the entry.
- A party may not commence court proceedings relating to any dispute arising from the Terms and Conditions without:
- Meeting with CoinSpot to (in good faith) resolve the Dispute; if the parties cannot resolve the Dispute at that meeting then
- The matter will be referred to a mediator:
- The parties agree to attend the mediation in good faith.
- The costs of the mediation will be shared equally between the parties.
- Nothing in this clause will operate to prevent a party from seeking urgent injunctive or equitable relief from a court.

Causation of Harm
- Any attempt, deliberate or otherwise, to cause malicious damage or interfere with the normal functioning of the Site, or the information on the Site, or to otherwise undermine the Terms and Conditions, or the legitimate operations of the Promotion, may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, CoinSpot reserves the right to seek damages to the fullest extent permitted by law.
- If CoinSpot suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by a Participant, the Participant agrees to indemnify CoinSpot for those losses, damages and costs.

Linked Sites
- The Platform for the Promotion may contain links to other websites. CoinSpot does not endorse and is not responsible for the content of any Linked Sites. Any Linked Sites displayed on the platform are for the Entrants’ convenience only and the Entrant agrees to access, use and otherwise deal with Linked Sites at their own risk.

Social Media
- Social media membership pages, applications and use of social media generally is subject to the prevailing terms and conditions of use of the social media platform.
- Unless otherwise indicated in these Terms and Conditions, the Promotion is in no way sponsored, endorsed or administered by, or associated with, any social media platform including, but not limited to, Instagram, Facebook, Twitter and Pinterest.
- If a Participant uses social media to participate in the Promotion, the Participant understands that they are providing their information to CoinSpot and not to any social media platform.
- Participants are solely responsible and liable for the content of their entries and any other information they transmit to other Internet users.
- By participating in the Promotion, the Participant releases Instagram, Facebook, Twitter, Pinterest or applicable social media sites from all claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs associated with the Promotion.

Miscellaneous
- Unless the contrary intention appears, a reference in these terms and conditions or in any advertisement relating to the Promotion, to Australian dollars, dollars, AUD$ or $ is a reference to the lawful currency of Australia.
- These Terms and Conditions may be amended or replaced from time to time if required by any regulatory authority.
- These Terms and Conditions represent the entire agreement between CoinSpot and any Participant (including winning Participants) and supersede any prior agreement, understanding or arrangement between CoinSpot and any Participant (including winning Participants), whether oral or in writing.
- CoinSpot excludes all warranties, guarantees or representations (whether express or implied) except as expressly provided in these Terms and Conditions.

Definitions
- Account means an account maintained by a Participant with CoinSpot.
- Dispute means any dispute which arises between CoinSpot and any Participant in relation to the Promotion.
- Eligible Person means a person who is eligible under Clause 4 to be a Participant.
- Linked Sites means any website for which a link appears in the Site.
- Participant means an Eligible Person who participates in the Promotion in accordance with Clause 5.
- Platform means all of CoinSpot's websites and digital or information technology platforms.
- Prize has the meaning given in Clause 6.
- Promotion means the promotion as described in, and governed by, these Terms and Conditions.
- Promotional Period has the meaning given in Clause 3.
- Redemption Period has the meaning given in Clause 8.
- Site means CoinSpot's website at https://www.coinspot.com.au.
- Terms and Conditions means the terms and conditions as more fully described and defined in Clause 2.
